Aviation Accidents

What law governs an airplane or helicopter crash is determined by the aircraft involved in the accident. If the crash involves a civilian aircraft, then legal negligence standards of “ordinary and reasonable” care apply.

Airline carriers, like a commuter or passenger airlines, are required to adhere to much greater standards of care than ordinary civilian aircraft operators. Thus, major airlines like Delta, United and American must go to great lengths to ensure the safety of their passengers.

Airline or civilian operators are not the only entities that may be held responsible for an airplane or helicopter crash. In fact, many airplane/helicopter crash cases involve the manufacturer of the aircraft, its subcontractors and the Maintenance Company responsible for the aircraft’s flight-worthiness.
