Notice of a Lawsuit

YOU AND THE LAW: Can you be sued and NOT be aware of it? YES! A process server (usually a sheriff deputy) may serve a law suit (with a citation) upon any individual of suitable age and discretion residing at your home. LA Code of Civil Procedure Article 1234 governs:

Art. 1234. Domiciliary service

Domiciliary service is made when a proper officer leaves the citation or other process at the …dwelling house or usual place of abode of the person to be served with a person of suitable age and discretion residing in the domiciliary establishment.

If you anticipate possible involvement in any form of litigation, it is wise to let all members of your household know to advise you immediately if any papers are brought to your house by a sheriff deputy or anyone claiming to be a court-appointed process server.
